SUBJECT ACCESS REQUEST

1. SCOPE

All personal data processed by Calex UK is within the scope of this procedure. This procedure excludes personal data that is asked of as a matter of routine by data subjects e.g. holiday or pay information.

Data subjects are entitled to ask:

  • Whether Calex UK is processing any personal data about that individual and, if so, to be given:
    • a description of the personal data;
    • the purposes for which it is being processed; and,
    • details of who will be allowed to see the personal data.
  • To be given a copy of the information and to be told about the sources from which Calex UK derived the information.

2. RESPONSIBILITIES

The Data Protection Officer / GDPR Owner is responsible for the application and effective working of this procedure, and for reporting on Subject Access Requests (SARs).

3. PROCEEDURE

3.1 Subject Access Requests must be made using the Subject Access Request form.

3.2 The data subject must provide evidence as to identity, in the form of a current passport, driving license, birth certificate, and the signature must be cross-checked to that on the application form.

3.3 The data subject must identify the data that is being requested and where it is being held and this information must be shown on the SAR application form. Note that the data subject is entitled to ask for all data that Calex UK holds, without specifying that data.

3.4 The date by which the identification checks and the specification of the data sought must be recorded; Calex UK has one month from this date to provide the requested information. There are no circumstances in which an  extension to that one month will be provided, and failure to provide the requested information within that one month is a breach of the GDPR.

3.5 The SAR application is immediately forwarded to the Data Protection Officer / GDPR Owner, who will ensure that the requested data is collected within the time frame. Collection will entail either:

3.5.1 Collecting the data specified by the data subject, or
3.5.2 Searching all databases and all relevant filing systems (manual files) in Calex UK, including all back up and archived files, whether computerised or manual, and including all
e-mail folders and archives Document reference: CX2001 – AUG 2018

3.6 The Data Protection Officer / GDPR Owner maintain a record of requests for data and of its receipt, including dates. Note that data may not be altered or destroyed in order to avoid disclosing it.

3.7 The Data Protection Officer / GDPR Owner is responsible for reviewing all provided documents to identify whether any third parties are identified in it and for either excising identifying third party information from the documentation or obtaining written consent from the third party for their
identity to be revealed.

3.8 If the requested data falls under one of the following exemptions, it does not have to be provided:

3.8.1 Crime prevention and detection

3.8.2 Negotiations with the requester

3.8.3 Management forecasts

3.8.4 Confidential references given by Calex UK (not ones given to Calex UK)

3.8.5 Information used for research, historical or statistical purposes

3.8.6 Information covered by legal professional privilege

3.9 The information is provided to the data subject in  electronic format unless otherwise requested and all the items provided are listed on a schedule that shows the data subjects name and the date on which the information is delivered.

3.10 The electronic formats used for responses to SARs are:

We understand that all users of our site and those who engage with us for Services or to be part of Calex as an employee should be confident that their data will not be used for any purpose  unintended by them, and will not fall into the hands of a third party not associated directly with Calex UK company operations.

ASSOCIATE INFORMATION

This is information given to us in the course of your business and ours as you have become part of our associate programme or a customer of our services. Such information is retained for business use only. We undertake to preserve the confidentiality of the information and of the terms of our
relationship. This information is used:

  • to maintain our accounts and associate records;
  • for billing;
  • to enable us to answer your enquiries;
  • for verifying your identity for security purposes;
  • to send you news about the services to which you have signed up;
  • to tell you about other of our services.

You may at any time request for a copy of the data held and chose for this to be removed from our systems if you no longer wish to be part of our service offer. To request your data to be removed please contact the Data Controller using this email address datacontroller@calexuk.com or call the office on 01235 553296 and ask to speak to the data controller.

BUSINESS INFORMATION
This is information given to us in the course of your business engagement and our service delivery such as in relation to your application to partner with us, employment, subcontract to deliver part of our service delivery or advertise with us. Such information is retained for business use only.

We undertake to preserve the confidentiality of the information and of the terms of our relationship. It is not used for any other purpose. We expect you and any partner to reciprocate this policy. Any data held can be requested and provided through formal Subject Access Request by contacting the Data Controller. If we need to keep your data for business purpose and audit we reserve the right to hold this data for 6 years. After this period you may request for your data to be removed.

DISCLOSURE TO GOVERNMENT AND THEIR AGENCIES

We are subject to the law like everyone else. We may be required to give information to legal authorities if they so request or if they have the proper authorization such as a search warrant or court order. We also share data with Government Departments such as the Education and Skills Funding Agency for the purpose of delivering UK  apprenticeships and may be subject to external audit for financial and quality purposes.

At any time you may review or update the personally  identifiable information that we hold about you, by contacting us at the address below or contacting the Data Controller
on datacontroller@calexuk.com. To better safeguard your information, we will also take reasonable steps to verify your identity before granting access or making corrections to your information. This confidentiality policy has been compiled so as to comply with current General Data Protection Regulation legislation, so far as we are aware.

If at any time you would like a copy of the data we hold or request for your data to be removed we will be happy to support this free of charge with 30 days.
